End-User License Agreement for Solar Project Builder<\/b><\/p>\n
This Solar Project Builder (\u201cSoftware Product\u201d) and accompanying documentation is licensed and not sold. This Software Product is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. The Midwest Renewable Energy Association or its subsidiaries, affiliates, and suppliers (collectively \u201cDevelopers\u201d) own intellectual property rights in the Software Product. The Licensee’s (\u201cyou\u201d or \u201cyour\u201d) license to download, use, copy, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (\u201cAgreement\u201d).<\/p>\n

Acceptance<\/b><\/p>\n
You accept and agree to be bound by the terms of this Agreement by selecting the \u201cCalculate\u201d button and using the Software Product. You must agree to all terms of the Agreement before you are allowed to use the Software Product. If you do not agree to all terms of this Agreement, do not select \u201cCalculate\u201d and do not use the Software Product. <\/span><\/p>\n <\/p>\n License Grant<\/b><\/p>\n This EULA grants you the following rights: Use. You may run an unlimited number of project calculations with the Software Product.<\/span><\/p>\n <\/p>\n Restrictions on Transfer<\/b><\/p>\n Without first obtaining the express written consent of Developers, you may not assign your rights and obligations under this Agreement, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to the Software Product.<\/span><\/p>\n <\/p>\n Restrictions on Copying<\/b><\/p>\n All title and copyrights in and to the Software Product (including but not limited to any images, photographs, clipart, libraries, and examples incorporated into the Software Product), the accompanying printed materials, and any copies of the Software Product are owned by the Developers of this software. The Software Product is protected by copyright laws and treaties. Therefore, you must treat the Software Product like any other copyrighted material. The licensed users or licensed company can use all functions, examples, templates, clipart, libraries, and symbols in the Software Product to create and distribute new solar project calculations and graphs.<\/span><\/p>\n <\/p>\n Privacy<\/b><\/p>\n Developers may use the information collected from you to maximize the services provided to you. You may change your details at any time by advising us in writing via email. All information we receive from you is protected by secure servers. \u00a0<\/span><\/p>\n <\/p>\n Third Parties<\/b><\/p>\n Developers will not sell or deal in personal or customer information. Developers may, however, use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and to assist it in meeting customer needs generally. In addition, Developers may use the information that you provide to improve its website and its services.<\/p>\n <\/p>\n Disclaimer of Warranties and Limitations of Liability<\/b><\/p>\n Unless otherwise explicitly agreed to in writing by Developers, parties make no other warranties, express or implied, in fact or in law, including, but not limited to any implied warranties of merchantability or fitness for a particular purpose other than as set forth in this Agreement. The entire risk arising out of use or performance of the Software Product remains with the user.<\/span><\/p>\n Developers make no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. Developers make no warranty that operation of the Software Product will be secure, error free, or free from interruption. The Software Product is not intended to provide exact financial values or timelines. \u00a0Rather, is intended to introduce users to possible financial mechanisms and important variables involved in developing a solar project. \u00a0You must determine whether the Software Product meets your requirements for security, interruptibility, and accuracy. <\/span><\/p>\n Under no circumstances shall Developers, its directors, officers, employees, contractors, or agents be liable to you or any other party for indirect, consequential, special, incidental, punitive, or exemplary damages of any kind (including lost revenues or profits or loss of business) resulting from this agreement, or from the furnishing, performance, or use of the Software Product. <\/span><\/p>\n <\/p>\n Severability<\/b><\/p>\n If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect.
